The dangers of

Registering without assistance

Registering a trade mark as a layman, without the assistance of a qualified attorney, can have several potential negatives and risks.

Lack of Legal Knowledge

Trade mark law can be complex, and without a thorough understanding of the legal requirements and procedures, there is a higher chance of making mistakes or overlooking critical aspects of the application process. This could result in the rejection of your application or potential legal disputes down the line.

Limited Experience with Trade Mark Searches

Conducting comprehensive trade mark searches is essential to ensure that your desired trade mark is unique and does not infringe upon existing trade marks. Laypersons may not have access to the necessary databases or the expertise to conduct thorough searches, increasing the risk of inadvertently choosing a trade mark that conflicts with an existing one.

Inadequate Identification of Goods and Services

Properly identifying the goods and services associated with your trade mark is crucial for protection and enforcement. Without the guidance of a trade mark attorney, you may fail to accurately describe your products or services, leaving your trade mark vulnerable to challenges or limited protection.

Incomplete or Incorrect Application

Trade mark applications require specific information and documentation to be submitted accurately. Without professional guidance, you may provide incomplete or incorrect information, leading to delays, rejection, or potential legal issues.

Inefficient Use of Time and Resources

Registering a trade mark involves numerous administrative tasks, correspondence with the trade mark office, and understanding legal jargon. As a layperson, you may spend significant time and effort navigating these processes, which could be better utilised on core business activities.

Increased Costs in the Long Run

While attempting to save money upfront by not engaging an attorney, the potential costs of mistakes, rejections, or legal disputes resulting from layperson registration can far outweigh the initial cost of professional assistance.

“Thanks to eTrademark.com.au registering my trade mark was a breeze. Their efficient and user-friendly platform made the process seamless. I highly recommend their services to anyone seeking professional and reliable trade mark registration assistance.”

Service Fee: Our service fee is $199+GST per class. If you need additional classes, each one incurs a fee of $99+GST. This fee is a one-time charge.

How it works
