Begin by providing your trademark information and completing the payment. In Australia, trademark registration costs vary based on the number of selected goods and services classes. You will be charged the Government fee and our Service Fee according to your class selections. Our team will then conduct an in-depth review of your submission and make necessary revisions before filing the application. If you choose to withdraw your application before lodgement, we'll reimburse the Government Fee and our Service Fee in its entirety. A trade mark operates as a unique identifier, often comprising a business or product name, logo, or phrase. Its fundamental role is to serve as a badge of origin, distinguishing your products or services from those of other traders. Iconic brands like Nike with its recognisable Swoosh, widely known names such as McDonald's, Microsoft, and Apple, among others, exemplify the power of trade marks. Your trade mark creates a link between your brand and your customers, deepening recognition and building consumer confidence.
Securing your trade mark registration grants you an exclusive entitlement to use your brand name or logo in connection with your goods or services. Additionally, it establishes an enforceable right to protect your brand against unauthorised use by other traders.
In Australia, the process of securing your trade mark registration requires a minimum of 7.5 months from the lodgement date. It's important to note that the lodgement date holds the most significance, establishing your priority over later filed marks that bear a significant resemblance to your application and are for the same or closely related goods or services. As your dedicated agents, we are committed to guiding you through the entire journey – from the initial application phase to the eventual registration and even the subsequent renewal process. Our expert team works diligently to streamline the process, aiming to secure your trade mark rights as efficiently as possible
Your trade mark will register for an initial term of 10 years but can be renewed indefinitely every 10 years. Therefore, as long as you continue to renew your trade mark you can own it forever. However, to ensure the ongoing security of your trade mark, it's essential to actively use it in any given 3 year period. This is because trade marks that are no longer used can become vulnerable to cancellation. Rest assured, as your agents we will make sure that your renewals are attended to in a timely manner so that your brand remains protected for as long as you require.
While registering your company or business name is a crucial step, it's important to note that these registrations do not confer enforceable brand rights. Unlike trade marks, they lack the capacity to prevent unauthorised use by others. The most effective avenue to secure your brand lies in trade mark registration, which provides the foundation for enforceable rights, enabling you to take legal action against infringing use.
Absolutely, your trade mark safeguards your domain when it aligns with the same name. This protection extends to domain names with extensions such as ‘.com.au’ since these extensions are viewed as generic. Additionally, your trade mark provides protection for your 'pty ltd' as long as your company name mirrors your registered trade mark.
